FDE App Privacy Policy
Version 2026-10-27
Effective: 2026-10-27
1. Who we are and what this covers
FDE App (formerly AI Ops Cloud) is run by ClickDown, LLC, doing business as 3rd Brain Digital Operations and as Digital Operations Institute, 14478 Corallin Drive, Chesterfield, Missouri 63017 ("3rd Brain", "we"). This policy explains what we collect about you when you visit our sites, use FDE App, or deal with us as a customer or prospect, what we do with it, and the choices you have. It is part of the FDE App Terms of Use.
Information you put into FDE App about your clients and the people in your recordings is handled on your behalf, as section 6 describes.
2. What we collect
| What | Examples | Where it comes from |
|---|---|---|
| Account information | Your name, email address, company, the workspaces you belong to, and your role in each | You, and our sign-in provider when you sign in |
| Billing information | For the paid plan and trials: the plan, price, and billing status of each company, the date it is paid through, when a trial started, and the IDs Stripe gives your customer record and subscriptions. Stripe holds your payment card or other payment details, billing name and address, and invoices; we never receive or store your full card number | You, through Stripe's checkout and billing pages, and Stripe |
| Course information | If you are accepted into one of our courses: your name and email address, the course code issued to you, and when it was issued, used, or revoked | Our course app, which shares your name and email address with FDE App to issue your code, and our staff |
| Your content | Library documents, connection settings, captured system data, recordings and their transcripts, follow-ups, exports | You, your workspace's members, and FDE App working on your instructions |
| Activity records | Sign-ins and sign-outs, each tool your AI assistant calls, each item the service serves, documents saved, the AI provider your assistant connects through (for example claude.ai), and the model usage of each recording job | The service, as you use it |
| Website and marketing data | Pages you visit on our sites, buttons you click, videos you play, the link, post, or ad that brought you, your device and browser type, and your approximate location from your IP address; once you sign up, this is linked to your account | Your browser, cookies and similar technologies, and our analytics and advertising providers |
| Communications | Emails, messages, support requests, survey answers, and calls and meetings with us, which we may record and transcribe | You |
| Information from others | Your job title, company, company size, business contact details, and public professional profiles (such as LinkedIn) | Data enrichment and business-information providers, public sources, social networks, partners, events and webinars, and people who refer you |
| Technical data | IP address and browser details in our hosting provider's request logs; cookies and similar technologies (section 3) | Your browser and our hosting provider |
3. Cookies and similar technologies
We use cookies, pixels, local storage, and similar technologies to:
- keep you signed in (the service needs these to work);
- remember your settings;
- understand how people find and use our sites and the service; and
- measure and improve our marketing, including showing our ads on other sites and platforms.
Some of these are set by our analytics and advertising providers (section 5), who may also collect information about your visits to other sites and use it under their own terms. You can block or delete cookies in your browser settings, but the service needs its sign-in cookies. Where the law requires your consent, we ask for it before setting cookies that aren't needed to run the service. We honor Global Privacy Control signals where the law requires it. We do not respond to Do Not Track signals.
4. How we use it
- To run the service for you: store your library, run your FDE App work, and show it to the people in your workspace.
- To bill you: take payment for the paid plan, run trials and renewals, calculate and collect taxes, handle failed payments, and keep the records tax and accounting law require.
- To issue and check course codes, and to apply what a code gives to your workspace.
- To protect the service and FDE App: detect and stop misuse, including copying of FDE App (Terms of Use sections 4 and 5).
- To support you when you ask.
- To improve the service and build new products and features, including AI models, using activity records, website and marketing data, feedback, and de-identified data. Never your content.
- To understand how people find and use our sites and the service, including linking what you did before you signed up (such as the link or ad that brought you) to your account.
- To market FDE App and 3rd Brain's services to you by email (you'll get our emails by default, and every marketing email has an unsubscribe link), phone, and social networks.
- To advertise to you and to people like you on other sites and platforms, including by giving advertising platforms a scrambled (hashed) form of your email address to find you there.
- To see whether 3rd Brain's services could help you, based on your account information, activity records, information from others, and your content, and to contact you about them (Terms of Use 6(i)).
- To create de-identified, combined data that does not identify you, your company, your clients, or anyone in them, and use it for any lawful purpose, such as publishing benchmarks (Terms of Use 6(h)).
- To meet legal obligations, enforce our terms, and protect our rights.
We do not use your content to train AI models.
We do not sell your information for money. Some US state laws treat letting advertising providers collect information through cookies and pixels, for ads on other sites, as a "sale" or "sharing" of personal information. To opt out of that, email us (section 8). We do not knowingly sell or share information about anyone under 16.
5. Who we share it with
Providers that run the service and our business for us, each only with what it needs:
| Provider | What it does | What it handles |
|---|---|---|
| Fly.io | Hosts the app and its workers (Chicago, United States) | Everything, while the service runs |
| Tigris | Stores files: recordings, captured data, exports, snapshots | Your content's files |
| Neon | Hosts the database (Ohio, United States) | Account information, your content, activity records, website and marketing data |
| WorkOS | Signs you in | Your name and email address |
| Stripe | Processes payments, runs subscriptions, trials, and the billing page, calculates and collects taxes (Stripe Tax), and sends receipts and reminders | Your name, email address, billing address, payment details, your workspace's name, and the plan and price you choose. Stripe also uses some of it under its own privacy policy, for example to prevent fraud and meet its legal obligations |
| Google (Gemini API) | Reads recordings when you index or question one | The recording and its transcript. We use a paid account, under which Google does not use the content to improve its products. Google keeps its working copy of a recording for up to 48 hours, and may keep request logs for a limited time to detect abuse, under its own terms |
| jsDelivr | Serves the diagram library Navigator loads in your browser | Your IP address, when your browser loads it |
| Analytics and advertising providers (for example Google and Meta) | Measure how people use our sites and how our ads perform, and show our ads | Website and marketing data, cookie identifiers, IP address, and hashed email addresses, under their own terms |
| Sales, marketing, and support tools (for example our CRM, email, data enrichment, and meeting-recording tools) | Keep track of our relationship with you, send our emails, fill in business details, and record and transcribe calls | Account information, communications, information from others, and activity records |
Also:
- Your AI assistant. You reach FDE App through an AI assistant you choose (for example Claude or ChatGPT). What your assistant reads from or writes to the service also passes through its provider, under your agreement with them, not this policy.
- Your workspace. A workspace's owners can see its members, their roles, and their activity in it.
- Our affiliates, current and future, under this policy.
- Anyone, when the information is de-identified and combined, as section 4 describes.
- When the law requires it, to protect our rights or someone's safety, or to a buyer of all or part of our business or its assets, who would have to honor this policy.
- With your consent or at your direction.
6. Your clients' data and the people in recordings
When you put a client's information into FDE App, or record people, we handle that information on your behalf and on your instructions. You decide what goes in, and you are responsible for having the right to share it and for giving any notice and getting any consent the law requires. Make sure the people in recordings know they are being recorded. Do not upload health records, payment card numbers, government ID numbers, or passwords or other credentials; the service is not built to hold them.
7. How long we keep it
We keep information for as long as we need it for the purposes in this policy, including to run and protect the service, to market to you, to resolve disputes, to enforce our terms, and to meet legal obligations. For your content specifically:
- Your content stays until you delete it, delete the company it belongs to, or delete your account or workspace.
- When your access ends, you can export your library for 30 days; then we delete your content.
- Backups. Deleted content leaves our nightly snapshots within 30 days, and our database provider's restore window within its own retention period.
- Billing records are kept for as long as tax and accounting law requires, even after your account is deleted. Stripe keeps its own records under its terms.
- Recordings sent to Google are kept by Google for up to 48 hours (its request logs for a limited time, under its terms).
Activity records and de-identified data may be kept after your account is deleted.
8. Your choices and rights
- See and take your content: the export gives you your whole library at any time.
- Correct it: edit it in the service, or ask us.
- Delete it: delete documents, a company, or your account in the service, or ask us.
- Billing: change your card, switch between yearly and monthly, see invoices, or cancel in Manage billing on your company's page.
- Marketing email: use the unsubscribe link in any marketing email. We'll still send emails about your account and the service.
- Cookies and ads: block or delete cookies in your browser, and use Google's and Meta's ad settings to limit the ads you see from them.
- Ask us anything about your information, or opt out of the "sale" or "sharing" described in section 4, at michael@3rdbrain.co. We answer within 30 days. Depending on where you live, you may have further rights under your local law; write to us and we will honor them as that law requires.
9. Security
Connections to the service are encrypted. Each workspace's data is kept apart from every other workspace's, and access is limited to the people in it and to us when running or supporting the service. No system is perfectly secure. If a breach affects your information, we will tell you as the law requires.
10. Children
Our sites and FDE App are for businesses. They are not for anyone under 18.
11. Where your information is
We store and process information in the United States. If you use the service from elsewhere, your information comes to the United States.
12. Changes
We may change this policy at any time by posting the new version here with its date. If a change is material, we may also tell you by email or in the service. Using our sites or the service after a change takes effect means you accept it.
